SmartMouth™ Social Media Giveaway Sweepstakes Official Rules (U.S.)

This sweepstakes (the “Sweepstakes”) may only be entered in or from the 50 United States and the District of Columbia, and entries originating from any other jurisdiction are not eligible. This Sweepstakes is governed exclusively by the laws of the United States. You are not authorized to participate in the Sweepstakes if you are not located within the 50 United States or the District of Columbia.
1. How to Enter; Selection of Winners
To enter the Sweepstakes, you must follow the official SmartMouth account on the platform where the giveaway post appears (Instagram: @smartmouthwash; Facebook: SmartMouth Mouthwash) and like the designated giveaway post as instructed in the post caption. Additional entry methods (if any) will be stated in the giveaway post caption on the applicable platform. Limit one (1) entry per person unless otherwise specified in the post. Receipt of entries will not be acknowledged. Delivery of the Prize (as defined below) requires a valid U.S. street address (no P.O. Boxes).
For giveaways conducted on multiple platforms, each platform’s giveaway post will constitute a separate Sweepstakes. Entries will only be eligible for the platform on which they are submitted, and one winner will be selected from each platform’s entries. Winners will be randomly selected from all eligible entries received on the applicable platform during the Sweepstakes Period.
2. Start/End Dates
Each Sweepstakes will begin and end on the dates and times stated in the corresponding giveaway post on the applicable platform (“Sweepstakes Period”). Entries must be received during the stated Sweepstakes Period to be eligible. If the Sweepstakes is run on multiple platforms, the start and end dates for each platform will be specified in that platform’s giveaway post.
3. Eligibility
Participation is open only to legal residents of the United States or the District of Columbia who are 18 years or older as of the date of entry. Void outside the 50 United States and the District of Columbia, and where prohibited, taxed, or restricted by law. All federal, state, and local laws and regulations apply.
4. Prize
The number of winners, description of prizes, and approximate retail value will be stated in the giveaway post. The Prize is non-transferable. No substitutions or cash redemptions are permitted, except that SmartMouth reserves the right to substitute a prize of equal or greater value in its sole discretion. UNCLAIMED PRIZES WILL NOT BE AWARDED. All unspecified expenses are the responsibility of the winner.
5. Notification
Winners will be tagged in the Sweepstakes post and/or notified via direct or private message on the applicable platform. Winners may be required to sign and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release within ten (10) calendar days of prize notification. If a winner cannot be contacted within five (5) calendar days of SmartMouth’s first notification attempt, if a Prize or Prize notification is returned as undeliverable, if a winner rejects their Prize, or in the event of noncompliance with these Official Rules, the Prize will be forfeited and an alternate winner may be selected from all remaining eligible entries for that platform.
6. Conditions
All federal, state, and local taxes are the sole responsibility of each winner. Participation and acceptance of the Prize constitutes the winner’s permission for SmartMouth to use their name, city and state, likeness, photograph, and/or any statements made regarding the Sweepstakes for advertising and promotional purposes without additional compensation, except where prohibited by law.
By participating, entrants agree to release and hold harmless SmartMouth, Meta Platforms, Inc. (Instagram and Facebook), and their respective affiliates, advertising and promotion agencies, and their respective parent companies, subsidiaries, partners, representatives, agents, successors, assigns, employees, officers, and directors (collectively, “Released Entities”) from any and all liability for any loss, harm, damage, injury, cost, or expense whatsoever, including, without limitation, property damage, personal injury, or death that may occur in connection with participation in the Sweepstakes, or possession, acceptance, and/or use or misuse of the Prize, or participation in any Sweepstakes-related activity.
SmartMouth is not responsible if the Sweepstakes cannot take place or if the Prize cannot be awarded due to events beyond its reasonable control, including, without limitation, acts of God, acts of war, natural disasters, weather, or acts of terrorism.
7. Additional Terms
In case of dispute as to the identity of any entrant, the entry will be deemed to have been made by the Authorized Account Holder of the social media account used to submit the entry. “Authorized Account Holder” is the natural person assigned to the account handle by the applicable platform. Proof of identity may be required.
Any use of robotic, automatic, programmed, or similar entry methods will void all such entries and disqualify the entrant. SmartMouth is not responsible for technical malfunctions, lost or unavailable network connections, or other errors that may interfere with entry.
SmartMouth reserves the right, in its sole discretion, to cancel, modify, or suspend the Sweepstakes should any cause beyond its control corrupt or affect the administration, fairness, or proper conduct of the Sweepstakes. In such case, winners will be selected from all eligible entries received prior to any action taken.
CAUTION: Any attempt to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may violate criminal and civil laws. SmartMouth reserves the right to seek damages to the fullest extent permitted by law.
8. Limitation of Liability; Disclaimer of Warranties
IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
9. Disputes; Governing Law
This Sweepstakes shall be governed by and construed under the laws of the State of Missouri without regard to conflict of laws principles. Any disputes arising under this Sweepstakes shall be resolved individually, without resort to class action, and exclusively in the state or federal courts located in St. Louis, Missouri, and participants consent to the personal jurisdiction of such courts.
10. Use of Data
By entering this Sweepstakes, you acknowledge and agree that SmartMouth may collect your personal information (such as name, contact information, and social media handle) to administer the Sweepstakes, verify eligibility, notify winners, and deliver prizes. SmartMouth may use a third-party platform or service provider, such as Woobox (https://woobox.com/privacy), to collect entries, manage the Sweepstakes, and randomly select winners. Any information you provide in connection with the Sweepstakes will be shared with that service provider and processed in accordance with both SmartMouth’s Privacy Policy (https://www.smartmouth.com/privacy-policy/) and the service provider’s privacy policy.
We retain Sweepstakes entry information only as long as necessary to fulfill the purposes described above, unless a longer retention period is required by law. By participating, you consent to our use and sharing of your information as described in this section.
